These Terms of Service ("Agreement") govern your access to and use of our website at app.magicreels.media and our AI-powered image generation tools.
By creating an account, accessing, or using the Service, you confirm that: (1) You have read and agree to this Agreement; (2) You are at least 18 years old; (3) You are not barred from using the Service under applicable laws.
2.1. Registration: To access features, you must create an account via our authentication providers. You agree to provide accurate information and keep it updated.
2.2. Security: You are responsible for all activities under your Account. You must notify us immediately of any unauthorized use. We are not liable for any loss resulting from your failure to secure your credentials.
2.3. One Account Policy: You may not create multiple accounts to abuse free tiers or promotional credits. We reserve the right to suspend accounts engaging in such practices.
3.1. Inputs and Outputs: The Service allows you to submit text prompts ("Inputs") to generate images ("Outputs"). All content is generated using third-party AI models.
3.2. Ownership: As between you and MagicReels, you own your Inputs and Outputs. We hereby assign to you all our right, title, and interest in and to the Outputs. You are free to use them for personal or commercial purposes.
3.3. License to Us: By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, reproduce, and display your Inputs and Outputs solely for the purpose of:
3.4. No AI Training: We do not use your Inputs or Outputs to train our own AI models. Third-party AI providers process your prompts solely to generate Outputs; please refer to their respective privacy policies for more information.
3.5. AI Limitations: You acknowledge that AI generation is probabilistic. We do not guarantee that Outputs will be unique, accurate, or free of errors. The same prompt may generate similar outputs for other users.
3.6. AI-Generated Content Disclosure: All images created through the Platform are generated by artificial intelligence. You acknowledge this and agree to disclose the AI-generated nature of any Output when required by applicable law, including but not limited to the EU AI Act (Article 50).
3.7. Social Media Publishing: The Platform offers an optional social media publishing feature that allows you to publish generated images to third-party platforms (currently Telegram). By using this feature: (a) you authorize us to interact with third-party platform APIs on your behalf using credentials you provide (such as Telegram bot tokens and channel identifiers); (b) you are solely responsible for ensuring you have the right to publish content to the connected channels; (c) you acknowledge that content published through our Platform is subject to the terms and policies of the respective third-party platform. We store your platform credentials securely on our servers and use them only to deliver the publishing service. You may disconnect your accounts at any time through the Platform.
You agree NOT to use the Platform to generate, upload, or share content that:
Moderation: We employ automated filters and manual review. We reserve the right to suspend accounts and report illegal content to relevant authorities without notice.
5.1. Payment Processor: Payments are processed securely by Stripe. We do not store your credit card details.
5.2. Credits: The Service operates on a credit system. Credits are digital goods used to trigger AI generation tasks.
5.3. No Right of Withdrawal (Important): By purchasing Credits, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal (the 14-day cooling-off period under EU Consumer Law) once the Credits are added to your account. A confirmation of this consent will be provided to you via email on a durable medium.
5.4. Refunds: All purchases are final and non-refundable, except where required by applicable law or in the event of a verifiable technical failure preventing service delivery on our end.
5.5. Expiration: Purchased credits do not expire as long as your account is active. Promotional (free) credits may have an expiration date specified at the time of issuance.
6.1. Your Right to Export: You may download your generated images at any time through the Platform at no additional cost. Upon request, we will provide your data in a commonly used, machine-readable format (e.g., PNG/JPEG images, JSON metadata).
6.2. Account Deletion: You may request deletion of your account at any time by contacting contact@magicreels.media. Upon deletion, your personal data will be removed within 30 days, except where retention is required by law (e.g., transaction records for tax purposes).
6.3. Suspension by Us: We reserve the right to suspend or terminate your access to the Service for conduct that violates this Agreement. Where possible, we will provide notice and the reason for suspension. Unused purchased credits at the time of suspension for reasons other than serious misconduct will be refunded proportionally.
In accordance with the Digital Services Act (DSA), we respect the intellectual property rights of others. If you believe any Content on the Service infringes your copyright, please send a notice to contact@magicreels.media containing:
8.1. "As Is" Service: To the maximum extent permitted by law, the Service is provided "as is" and "as available". We disclaim all warranties, express or implied.
8.2. Liability Cap (Business Users): For business users, our total liability for any claims arising out of this Agreement shall not exceed the amount you paid us in the 12 months preceding the claim.
8.3. Consumer Rights: Nothing in these Terms limits or excludes legal rights that you are entitled to as a consumer under EU and Polish law which cannot be contractually altered or waived. In particular, statutory warranty rights and consumer protection provisions of your country of residence remain unaffected.
8.4. Third-Party Models: We utilize third-party AI models and cloud infrastructure. We are not liable for the availability, accuracy, or output quality of these third-party services.
9.1. Governing Law: These Terms are governed by the laws of Poland. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
9.2. Consumer Protection: If you are a consumer residing in the EU, you shall also benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
9.3. Jurisdiction: For business users, any disputes shall be brought before the competent courts in Warsaw, Poland. For consumers within the EU, jurisdiction lies with the competent court of the consumer's place of residence.
9.4. Amicable Resolution: Before filing a claim, you agree to try to resolve the dispute informally by contacting contact@magicreels.media. We will try to resolve the dispute within 30 days.
9.5. ODR Platform: Consumers in the EU can use the Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
We may modify these Terms from time to time. Changes fall into two categories:
10.1. Material Changes (changes that affect your rights, obligations, fees, or the scope of the Service): We will notify you at least 14 days in advance via email or a prominent notice on the Platform. If you do not agree with the changes, you may terminate your account before the new Terms take effect.
10.2. Non-Material Changes (corrections of typographical errors, clarifications of existing provisions, addition of new features or services that do not restrict your existing rights, or changes to technical or administrative details): These take effect immediately upon publication on the Platform. We will update the "Last Updated" date at the top of this page.
Your continued use of the Service after any changes take effect constitutes acceptance of the updated Terms.
